clarification of nekochan's commercial software policy

Unread postby HerpDerpMcGerp » Mon Apr 23, 2012 8:44 pm

Does Nekochan's ban against discussing trading commercial software apply to software that is 20 years old, unsupported and originally sold by a company which is no longer in existence? (ie, "abandonware")

It would seem contrary to the whole spirit of preservation on which this SGI-collector's community is based.

If so, can someone explain the rationale? Why can't we have a nice abandonware page for ancient commercial relics?

It exists, it's elsewhere, on those other websites.. This (privately owned) website is running from one man's closet who doesn't want to deal with extra headaches of software which is illegal in some territories.

Fair enough. I still think it's silly -- if Home of the Underdogs has survived this long (and old DOS games are way more mainstream than anything we'd be dealing with), then it seems *entirely* unlikely that anybody would come knocking to complain.

Actually, it's quite reasonable. Neko has already been harrassed a few times for things that would seem silly. The only way to avoid those hassles entirely is to avoid that subject entirely. If you screw teenaged girls, one day you'll get one who says she's 18 but is really only 17. Boom ! End of life.

Easier to avoid sex with teenagers entirely.

On the other hand, we would welcome it if you put up a site dedicated to abandonware.

Good preaching...

On the abandonware part - its legal aspect is questionable, and varies from state to state and country to country,
even if *someone* thinks it's fine to share 20-year-old software created by nonexistent publisher, the legal rights are still out there somewhere,
the publisher could have been taken-over, and even if it were shut down, the legal rights *may* in fact still belong to the debtors or employees and I could keep this going on forever.
Think of a software house that goes bankrupt, gives away its assets to the shareholders (that may include patents and previously released (even unreleased) software) who may have nothing to do with them but to stow away in the basement, but suddenly 20 years later they recall something about the software that shows up on a website and would like to execute on their legally obtained right to recover their money - want to battle them ? no thanks.

It's just too much risk, neko has enough work on the site anyway...

This topic is over I think...
